Title problems we see in Montana

  • Fractured title: land owned by several heirs, some unknown or unreachable
  • Missing heirs: someone on title has died or can't be located
  • Unprobated estates: a prior owner died and the land never went through probate
  • Old liens and judgments, sometimes decades old and possibly already paid
  • Boundary issues: fences that don't match the legal description, or overlapping deeds
  • Odd or outdated legal descriptions, common with old mining claims and homestead splits

Why title problems stop most sales

Before a buyer pays for land, a title company searches the public record and issues a commitment for title insurance. If it finds a gap in ownership, an unreleased lien, or an heir who never signed, the commitment lists it as a requirement. Until that's resolved, the sale usually can't close.

Most retail buyers and agents don't have the patience for that. The deal falls apart and the owner is stuck.

How we handle it

We read the title commitment with you and sort the problems into simple ones and complicated ones. A lot of issues are simpler than they look: a lien that was paid but never released, a deed with a typo, a missing death certificate. The title company can often clear those quickly.

For harder problems like missing heirs, unprobated estates, or fractured ownership, our sister company TitleQuest Pro does the curative work. They help locate heirs, coordinate the legal steps, and get the title to a point where the land can be sold.

Because we do this regularly, we can often make an offer even before every problem is solved, with closing timed around the cure.

This is general information, not legal advice. Some title problems require a Montana attorney.

What it means for your price

Title work takes time and sometimes money. We factor that into our offer honestly and show you how. Often, the alternative is land that can't be sold at all, so a fair offer that accounts for the cure is a real option worth hearing.
